أما الناحية السلبية في عمليات الشحن البحري فهي تتمثل في التعقيد الكبير في
المصطلحات المستخدمة في عقود الشحن البحري حيث تتداخل المسؤوليات
وتتشعب بين المصدر والشاحن والناقل والمستورد بشكل كبير جداً هذا في حال لم
يدخل أطراف أخرى في هذا العقد مثل البنوك الاعتمادية بالنسبة للمصدر
وللمستورد وشركات التأمين .
لتبسيط هذه المعضلة توصل اتحاد غرف التجارة العالمي إلى اعتماد تفسير موحد
للمصطلحات المستخدمة في عقود الاستيراد والتصدير والشحن البحري وجرى
نشر هذه المصطلحات تحت اسم INCOTERMS بهدف تبسيط العمليات وفصل المسؤوليات.
إن التحضير لعملية الشحن البحري وتنفيذها يتطلب وقتاً طويل نسبةً لأنواع
الشحن الأخرى، والافتراض الأساسي عند الشاحن تجاه المصدر أن الأخير قد
برمج توقيتات تصدير شحناته مع المستورد على أساس الحد الافتراضي الأعلى
لزمن الشحن البحري، وهنا لا بد للمصدر أن يكون على اطلاع كامل على الفترات
الزمنية التي تتطلبها عملية الشحن البحري، وفيما يلي عرض لهذه المراحل:
1- مرحلة تحضير البضائع: يتم في هذه المرحلة تجميع البضائع في مكان مناسب ( مستودعات المصدر) وتغليفها بشكل مناسب وحماية البضائع التي تحتاج إلى حماية خاصة مما يسهل عمليات المناولة والتستيف لهذه البضائع.
2- تحديد خط الملاحة البحرية الذي سيتم اعتماده لتنفيذ عملية النقل بين مينائي التحميل والتفريغ، وحجز الحاوية التي سيتم وضع البضائع فيها، وكذلك حجز مكان للحاوية على ظهر المركب الذي ستغادر عليه الحاوية من ميناء التحميل وحتى نهاية خط الرحلة في ميناء التنزيل.
3- مرحلة نقل البضائع من مستودعات المصدر إلى ميناء التحميل البحري: بحسب شروط الاتفاق مع الشاحن والمستورد قد يقوم المصدر بهذه العملية بنفسه أو عن طريق شركة الشحن علماً أن الشحن البحري يعتمد في تكوين أسعاره على وحدة التحميل المستخدمة وهي في الحالات الاعتيادية الحاوية من فئة 20قدم أو ما يعادلها من الحجم الحر وهو يعادل 33م3 تقريباً فإذا كانت البضائع ستحمل في حاوية يجب تحديد نوع الحاوية المستخدمة وسعتها حيث يوجد عدة أنواع من حاويات الشحن البحري من حجمين رئيسيين 20قدم و 40قدم، وبعد تحديد نوع الحاوية المطلوب استخدامها نجد أمامنا أحد احتمالين:
آ- تحميل البضائع في شاحنة و نقلها إلى الميناء وتفريغ حمولة الشاحنة في الحاوية داخل ميناء التحميل وهذه العملية تنطوي على مخاطر تضرر البضائع خلال عملية النقل إلى الميناء من جراء العوامل الجوية في حال عدم استخدام شاحنة مناسبة أو الفقدان لبعض أجزاء الشحنة بسبب أخطار الطريق البري.
ب- نقل الحاوية من الميناء إلى المستودعات حيث البضائع وتحميلها تحت مراقبة المصدر وعندها يمكن إغلاق الحاوية وختمها مما يشكل عامل أمان أكبر بالنسبة للمصدر وحماية بدرجة عالية للبضائع، على الرغم من أن تكلفة هذه الحالة قد تزيد قليلاً عن الحالة الأولى نت يجة الحاجة إلى السرعة في إنهاء هذه المرحلة لمنع ترتب أجور إضافية للشاحنة التي تحمل الحاوية ( 4 ساعات تقريباً) إلا أنه ينصح بها بسبب الميزات السابقة الذكر.
4- إتمام المعاملات الجمركية والقانونية:
يمكن إتمام هذه المعاملات في مدينة المصدر أو في ميناء المغادرة ولكن ينصح بالحل الثاني لنفس السبب المذكور في البند 3- ب ( أجور إضافية على الشاحنة التي تحمل البضاعة) حيث تنزل الحاوية في مكان مناسب في الميناء لتحمل على ظهر المركب وتستكمل كافة الإجراءات دون الحاجة إلى إعادة تحري ك الحاوية من المكان الذي أخذته في الميناء، إن الفترة القصوى لإتمام عمليات التخليص الجمركي يمكن أن تصل إلى عشرة أيام بحسب نوع البضائع وما تطلبه سلطات الجمارك والميناء من مراقبة عليها.
5- تسليم كامل مستندات الشحنة إلى شركة التوكيلات الملاحية مع إعلام الشحن لاستصدار فاتورة التحميل والنقل البحري Bill of Lading ويرمز لها B/L . نيابةً عن شركة الملاحة البحرية التي ستقوم بعملية النقل على متن مراكبها وبهذه العملية تصبح الشحنة تحت المسؤولية المشتركة لشركة التوكيلات الملاحية و إدارة الميناء وشركة الملاحة البحرية الناقلة، علماً أن فاتورة التحميل الصادرة تبقى بيد شركة التوكيلات الملاحية لحين مغادرة المركب الذي سيحمل الشحنة.
6- تحميل الشحنة على ظهر المركب.
7- مغادرة المركب واستخراج فاتورة التحميل للشحنة من شركة التوكيلات الملاحية.
إن جملة المراحل السابقة الذكر تتطلب المتابعة الدقيقة من قبل شركة الشحن، ولكي تكون هذه المتابعة فعالة من الضروري التعاون ما بين المصدر والشاحن والمستورد من بداية العملية بتجميع البضائع في مستودعات المصدر وحتى نهايتها باستلام المستورد لشحنته في المكان والزمان المتفق عليه.
المقصود بالتعاون أن يقوم المصدر بتأمين الثبوتيات التي تطلب منه في أقصر وقت ممكن وأن يقوم المستورد بإعطاء المعلومات الدقيقة عن مكان التسليم بكلام آخر أن تكون شروط العقد واضحة وأن تتوفر الشفافية والمصداقية في المعلومات المتداولة بين كل أطراف العملية
يتعرض الشحن البحري لطيف واسع من المخاطر بدءاً من عمليات التحضير وحتى انتهاء عمليات التسليم لذلك من المهم التأمين على البضائع المشحونة بحراً من قبل الطرف المعني بكل مرحلة من المراحل حيث يمكن للمصدر أن يؤمن على الشحنة من مستودعه وصولاً إلى ظهر المركب ومن ثم يقوم الشاحن بالتأمين على الشح3نة خلال عملية النقل البحري وصولاً إلى ميناء المقصد قبل تفريغ الشحنة ثم يتولى المستورد التأمين على الشحنة من سطح المركب وصولاً إلى مستودعاته.
